Buyer understands that Photographer is the sole and exclusive holder and owner of the copyright of each image and Buyer is receiving a non-exclusive, limited commercial use license as set forth below. Photographer retains all rights to the images, including but not limited to, the right to sell, copy, display, and/or publish any and all images, for any reasons, including but not limited to marketing, advertising, print competitions, gallery, and for use on Photographer’s website, selling in store or online, portfolio, blog, and social media platforms.

Buyer Usage; Non-exclusive limited personal use license.

Buyer is purchasing digital files and Photographer is issuing to Buyer a non-exclusive, perpetual license for Buyer’s limited personal use of the digital files. Buyer understands that the digital files are meant for personal printing and sharing with friends and family. The digital files may be not altered, edited, or manipulated in any way. The digital files may not be used by anyone other than the Buyer. The Buyer cannot sell, lease, or give images to a third party without permission.

Governing Law, Jurisdiction and Venue.

This Agreement shall be governed by the laws of the State of Washington without giving effect to the principals of conflicts of law. The parties consent to jurisdiction and venue in the state and federal courts located in the State of Washington.

Warranty.

There is no warranty, express or implied, with the purchase of this digital image or video file. Photographer will not be liable for any claims, or incidental, consequential or other damages arising out of this license or buyer’s use of the Media.
